It's not about content. If I subscribe to a product announcement list, I
am guarantied to receive unwanted e-mail, because not all of the relevant
products will be of interest to me. Even if I have a profile that limits
the permission to a single model of a single product, I'm bound to see
reports of issues relevant only to specific engineering levels. Those
unwanted e-mails are not spam, because they are included in what I
consented to.
Now, if I signed up for announcements of printers and they send me a disk
announcement, that is spam. Not because I might not need another disk
drive right now, but because I didn't consent to it.
The problem with the ESP's is that they have a vested interest in
believing[1] customers who lie about their lists being opt-in.
